This Order may be cited as the District Councils (Rateable Areas) (Declaration) Order.

2.   Declaration of rateable areas

The rateable area of each District Council shall be as described in the Schedule hereto.

PART I

1. The rateable area of each of the following District Councils shall be as described respectively for such Council in Statutory Instrument No. 211 of 1977.

2. A Rateable Area Plan for each of the District Councils has been prepared by the Surveyor- General, is dated 11th May, 1981, and a copy thereof is deposited with the Minister and with the District Executive Secretary of such District Council.

3. The respective number of each Rateable Area Plan is set out in Column 2 against the name of the District Council.

1.   Title

This Order may be cited as the District Councils (Rateable Property) (Exemption) Order.

2.   Exempted property

The property described in the Schedule hereto shall not be Rateable property for the purposes of the Act.

      (a)   Lands and buildings used for mining or mineral processing purposes belonging to the Zambia Consolidated Copper Mines Limited.

      (b)   Machinery or plant (together with the shafting, pipes, cables, wires and other appliances and structures accessory thereto) used for mining or mineral processing purposes, belonging to the Zambia Consolidated Copper Mines Limited.

   (2) Agricultural land and buildings on such land, used primarily for the purposes of agriculture excluding residential and recreational buildings.

   (3) Lands and buildings situated in Trust Land or in the Reserves.* *Now referred to as customary area; section 2 of the Lands Act')">13

KAPIRI MPOSHI DISTRICT COUNCIL

The rateable of the Kapiri Mposh District Council shall be as described in Statutory Instrument No. 106 of 1996 and shown on the rateable area plan No. 54 prepared by the Surveyor General and dated 23rd July, 1997 a copy of which is deposited with the Minister and with Secretary, Kapiri Mposhi District Council.

MKUSHI DISTRICT COUNCIL

The rateable of the Mkushi District Council shall be as described in Statutory Instrument no. 106 of 1996 and shown on the Rateable Area Plan No. 3 prepared by the Surveyor General and dated 24th April, 1998 a copy of which is deposited with the Minister and with the secretary, Mkushi District Council.

COPPERBELT PROVINCEMPONGWE DISTRICT COUNCIL

The rateable of the Mpongwe District Council shall be as described in Statutory instrument No. 106 of 1996 and shown on the Rateable Area Plan No. 60 prepared by the Surveyor General and dated 23rd July 1997. A copy of which is deposited with the Minister and with the Secretary, Mpongwe District Council.

LUFWANYAMA DISTRICT COUNCIL

The rateable of the lufwanyama District Council shall be as described in Statutory instrument No. 106 of 1996 and shown on the rateable area plan no. 61 prepared by the Surveyor General and dated 23rd July, 1997 a copy of which is deposited with the Minister and with the Secretary, Lufwanyama District Council.

MASAITI DISTRICT COUNCIL

The rateable area of the Masaiti District Council shall be as described in Statutory instrument No. 106 of 1996 and shown on the Rateable Area Plan No. 12 prepared by the Surveyor General and dated 23rd July, 1997 a copy of which deposited with the Minister and with the Secretary, Masaiti, District Council.

EASTERN PROVINCECHIPATA MUNICIPAL COUNCIL

The rateable of the Chipata District Council shall be as described in the Statutory instrument No. 118 of 1997 and shown on the rateable area plan No. 16 prepared by the Surveyor General and dated 14th April, 1998 a copy of which is deposited with the Minister and with the Town Clerk, Chipata Municipal Council.

MAMBWE DSTRICT COUNCIL

The rateable of the Mambwe District Council shall be described in Statutory Instrument No. 118 f 1997 and shown on the Rateable area plan No. 62 prepared by the Surveyor General and dated 13th April, 1998 a copy of which is deposited with the Minister and the Secretary, Mambwa District Council.

PETAUKE DISTRICT COUNCIL

The rateable of the Petauke District Council shall be as described in Statutory instrument No. 118 of 106 of 1996 and shown on the rateable area plan No. 19 prepared by the Surveyor General and dated 23rd July, 1997 a copy of which is deposited with the Minister and with the Secretary, Petauke District Council.

NYIMBA DISTRICT COUNCIL

The rateable area of the Nyimba District Council shall be as described in Statutory instrument No. 106 of 1997 and shown on the rateable area plan No. 16 prepared by the Surveyor General and dated 23rd July, 1997, a copy of which is deposited with the Minister and with the Secretary, Nyimba District Council.

LUSAKA PROVINCECHONGWE DISTRICT COUNCIL

The rateable area of the Chongwe District Council shall be as described in Statutory instrument No 106 of 1996 and shown on the rateable area plan No. 26 prepared by the Surveyor General and dated 23rd July, 1997 a copy of which is deposited with the Minister and with the Secretary, Chongwe District Council.

KAFUE DISTRICT COUNCIL

The rateable area of the Kafue District Council shall be as described in Statutory instrument No. 106 of 1996 and shown on the rateable area plan No. 57 prepared by the Surveyor General and dated 23rd July, 1997 a copy of which is deposited with the Minister the Secretary, Kafue District Council.

SOUTHERN PROVINCENAMWALA DISTRICT COUNCIL

The rateable area of the Namwala District Council shall be as described in Statutory instruments No. 118 of 1997 an shown on the rateable area plan No. 47 prepared by the Surveyor General and dated 14th April, 1998 a copy of which is deposited with the Minister and with the Secretary, Namwala District Council.

ITEZHI TEZHI DISTRICT COUNCIL

The rateable area of the Itezhi Tezhi District council shall be as described in Statutory instrument No. 118 of 1997 and shown on the Rate-able Area Plan No. 70 prepared by the Surveyor General and dated 14th April, 1998 a copy of which is deposited with the Minister and with the Secretary, Itezhi Tezhi District Council.

KAZUNGULA DISTRICT COUNCIL

The rateable area of the Kazungula District Council shall be as described in Statutory instruments No. 118 of 1997 and shown on the rateable area plan No. 71 prepared by the Surveyor General and dated 14th April, 1998 a copy of which is deposited with the Minister and with the Secretary, Kazungula District Council.

KALOMO DISTRICT COUNCIL

The rateable area of the kalomo District Council shall be as described in Statutory instrument No. 118 of 1997 and shown on the rateable area plan No. 43 prepared by the Surveyor General and dated 14th April, 1998 a copy of which is deposited with the Minister and with the Secretary, Kalomo District Council.

SIAVONGA DISTRICT COUNCIL

The rateable area of the Siavonga District Council shall be as described in Statutory instrument No. 106 of 1996 and shown on the rateable area plan No. 58 prepared by the Surveyor General and dated 14th April, 1998 a copy of which is deposited with the Minister and with the Secretary, Siavonga District Council.

SINAZONGWE DISTRICT COUNCIL

The rateable area of the Sinazongwe District Council shall be as described in Statutory instruments No. 106 of 1996 and shown on the rateable area plan No. 59 prepared by the Surveyor General Dated the 14th April, 1998 a copy of which is deposited with the Minister and with the Secretary, Sinazongwe District Council.

LIVINGSTONE CITY COUNCIL

The rateable area of livingstone City Council shall be as described in Statutory instrument No. 118 of 1997 and shown on the Rateable Area Plan No. 44 prepared by the Surveyor General and dated 24th April, 1998 a copy of which is deposited with the Minister and with the Secretary, Livingstone City Council.

NORTHERN PROVINCEMPULUNGU DISTRICT COUNCIL

The rateable area of Mpulungu District Council shall be as described in Statutory Instrument No. 118 of 1997 and shown on the Rateable area plan No. 66 prepared by the Surveyor General and dated 14th April, 1998 a copy of which is deposited with the Minister and with the Secretary, Mpulungu District Council.

MBALA MUNICIPAL COUNCIL

The rateable area of the Mbala District Council shall be as described in Statutory instrument No. 118 of 1997 and shown on the Rateable Area Plan No. 33 prepared by the Surveyor General and dated 14th April, 1998 a copy of which is deposited with the Minister and with the Town Clerk, Mbala Municipal Council.

NAKONDE DISTRICT COUNCIL

The rateable area of the Nakonde District Council shall be described in Statutory instrument No. 106 of 1997 and shown on the Rateable area plan No. 55 prepared by the Surveyor General and dated 23rd July, 1998 a copy of which is deposited with the Minister and with the Secretary, Nakonde, District Council.

ISOKA DISTRICT COUNCIL

The rateable area of the Isoka District Council shall be as described in Statutory instrument No. 106 of 1997 and shown on the rateable area plan No. 29 prepared by the Surveyor General and dated 14th April, 1998 a copy of which is deposited with the Minister and the Secretary, Isoka District Council.

MUNGWI DISTRICT COUNCIL

SENANGA DISTRICT COUNCIL

The rateable area of the Senanga District Council shall be as described in statutory instruments No. 118 of 1997 and shown on the rateable plan No. 52 prepared by the Surveyor General and dated 14th April, 1998 a copy of which is deposited with the Minister and with the Secretary, Senanga District Council.

NORTH WESTERN PROVINCECHAVUMA DISTRICT COUNCIL

The rateable area of the Nchelenge District Council shall be as described in Statutory instrument No. 118 of 1997 and shown on the rateable area plan No. 23 prepared by the Surveyor General and dated 14th April 1998 a copy of which is deposited with the Minister and with the Minister and with the Secretary, Nchelenge District council.

MILENGE DISTRICT COUNCIL

The rateable area of the Milenge District Council shall be as described in Statutory instrument No. 118 of 1997 and shown on the rateable area plan No. 64 prepared by the Surveyor General and dated 14th April, 1998, a copy of which is deposited with the Minister and with the Secretary, Milenge District Council.

This order may be cited as the Lusaka City Council (Differential Rating), Order, 2001.

2.   Declaration of differential rating

The Lusaka city Council shall levy and collect ordinary rates for the different classes of the properties as follows–

      (a)   One (1) ngwee in a Kwacha in respect of residential properties; and

      (b)   One and Half (1.5) ngwee in a Kwacha in respect of commercial and industrial properties.
