AN ACT

to repeal and replace the Presidential Emoluments Act; to provide for the revised salary, allowance and gratuity payable to the holder of the office of President; and to provide for matters connected with or incidental to the foregoing.

1.   Short title

This Act may be cited as the Presidential Emoluments Act.

 

2.   Salary and allowance

   (1) The President shall be paid a salary and allowance at such rate as the Minister responsible for finance may prescribe, by statutory instrument, in consultation with the Standing Orders Committee of the National Assembly.

   (2) For the avoidance of doubt, the President shall continue to receive the salary and allowances applicable until the coming into operation of such statutory instrument as the Minister responsible for Finance may prescribe under sub-section (1).

3.   Gratuity

   (1) A person who has held the office of President shall, upon the expiration of a term of office or upon ceasing to be President, be paid a gratuity equal to one hundred percent of the aggregate amount of emoluments paid or payable to the person in respect of the period spend in office.

   (2) Where a person who holds office of President ceases to hold office—

      (a)   by reason of death; or

      (b)   when a new President assumes office after an election following the dissolution of Parliament before its full term;

that person shall be deemed to have served as President for the purpose of this section.
