1.   Title

This Order may be cited as the Tourism and Hospitality Act (Commencement) Order, 2008.

 

2.   Commencement of Act No. 23 of 2007

The Tourism and Hospitality Act, 2007, shall come into operation on the date of publication of this Order.

PART I
PRELIMINARY

 

1.   Title

These Regulations may be cited as the Tourism and Hospitality (Licensing) Regulations, 2009.

 

2.   Interpretation

In these Regulations, unless the context otherwise requires–

“authorisation” means the written consent of the Director, granted under regulation 7, for the construction, reconstruction, renovation, rehabilitation or alteration of a tourism enterprise;

“Committee” has the meaning assigned to it in the Act;

“hotel” has the meaning assigned to it in the Act;

“licence” means a licence obtained under regulation 8; and

“tourism enterprise” has the meaning assigned to it in the Act.

PART II
APPLICATION FOR AUTHORISATION AND LICENCE

 

3.   Application for authorisation

An application for authorisation to construct, reconstruct, renovate, rehabilitate or alter the structure of a tourism enterprise shall be made to the Director in Form I set out in the First Schedule.

 

4.   Application to operate tourism enterprise

An application to operate a tourism enterprise shall be made to the Director in Form II set out in the First Schedule.

 

5.   Application by agent

An agent who makes an application on behalf of another person shall submit, with the application, Form III set out in the First Schedule.

 

6.   Request for further particulars

A request for further particulars shall be made in Form IV set out in the First Schedule.

 

7.   Authorisation and tourism enterprise licence

      (1)   An authorisation shall be in Form V set out in the First Schedule.

      (2)   A tourism enterprise licence shall be in Form VI set out in the First Schedule.

 

8.   Rejection of application by Committee

The Committee shall, where the Committee rejects an application for an authorisation or a licence, inform the applicant of the rejection in Form VII set out in the First schedule.

 

9.   Appeals

An appeal against the refusal of the Committee to approve an application for an authorisation or a licence shall be made to the Minister in Form VIII set out in the First Schedule.

 

10.   Application to transfer authorisation or licence

   (1) An application to transfer an authorisation or licence shall be made to the Committee in Form IX set out in the First Schedule.

   (2) An application to transfer an authorisation or licence shall be accompanied by an application for an authorisation or licence, as the case may be, made by the prospective transferee.

   (3)   The Committee shall, where the Committee–

      (a)   rejects an application to transfer an authorisation or licence, endorse the rejection on the authorisation or licence; and

      (b)   grants an application to transfer an authorisation or licence, endorse the grant on the authorisation or licence.

 

11.   Application to vary authorisation or licence

   (1)An application to vary or amend the terms and conditions attached to an authorisation or a licence shall be made to the Committee in Form X set out in the First Schedule.

   (2)The Committee shall, where the Committee–

      (a)   rejects an application to vary or amend the terms and conditions attached to an authorisation or licence, endorse the rejection on the authorisation or licence; and

      (b)   grants an application to vary or amend the terms and conditions attached to an authorisation or licence, endorse the grant on the authorisation or licence.

 

12.   Notification of inability to implement authorised or licensed developments

A holder shall notify the Committee of the holder’s inability to implement the developments in respect of which an authorisation was granted in Form XI in the First Schedule.

 

13.   Application for renewal

   (1) An application for the renewal of a hotel or tourism enterprise licence shall be made to the Director in Form XII set out in the First Schedule.

   (2)   The Committee shall, where the Committee–

      (a)   rejects an application for renewal of a licence, endorse the rejection on the licence; and

      (b)   grants an application for renewal of a licence, endorse the grant on the

 

14.   Returns

A holder of a licence to operate a tourism enterprise shall submit quarterly returns to the Director in Forms XIII and XIV set out in the First Schedule.

 

15.   Suspension or revocation of licence

The Committee shall suspend or revoke a licence in Form XV set out in the First Schedule.

 

16.   Fees

The fees set out in the Second Schedule are payable in respect of the matters specified therein.

 

17.   Repeal of SI No. 112 of 1980 and No. 132 of 1992

The Tourism Regulations, 1980, and the Hotel (Licence Fees) Regulations, 1992, are hereby repealed.
