1. Title

This Order may be cited as the Non-Governmental Organisations Act, (Commencement) Order, 2011.

2. Commencement of Act No. 16 of 2009

The Non-Governmental Organisations’ Act, 2009, shall come into operation on the date of publication of this Order.

1. Title

These Regulations may be cited as the Non-Governmental Organisations’ (Forms and Fees) Regulations, 2011.

2. Interpretation

In these Regulations, unless the context otherwise requires–

“Register” means the Register kept pursuant to section 20 of the Act; and

“Registrar” has the meaning assigned to it in the Act.

3. Application for registration

An application for registration of a non-governmental organisation shall be made in Form I set out in the First Schedule.

4. Application for exemption from registration

An application for exemption from registration by a non-governmental organisation shall be made in Form I set out in the First Schedule.

5. Request for information

The Registrar may request an applicant to submit information in relation to an application in Form II set out in the First Schedule.

6. Rejection of application for registration

The Registrar shall, where the Board rejects an application, inform the applicant in Form III set out in the First Schedule.

7. Certificate of registration

   (1) The Registrar shall issue a certificate of registration in Form IV set out in the First Schedule.

8. Renewal of certificate of registration

An application for the renewal of a certificate of registration shall be made in Form V set out in the First Schedule.

9. Suspension or cancellation of certificate of registration

      (1) The Registrar shall, where the Board–

      (a)   intends to suspend or cancel the certificate of registration of a non-governmental organisation, notify the holder in Form VI set out in the First Schedule; and

      (b)   suspends or cancels the certificate of registration of a non-governmental organisation, notify the holder in Form VII set out in the First Schedule.

   (2) The Registrar shall, where the Board suspends or cancels the certificate of registration of a non-governmental organisation, endorse the cancellation or suspension on the certificate of registration.

10. Duplicate certificate of registration

An application for a duplicate certificate of registration shall be made in Form VIII set out in the First Schedule.

11. Notice of change of name, constitution, rules or objectives of organisation

An application for a change of name, constitution, rules or objectives of a non-governmental organisation shall be made in Form IX set out in the First Schedule.

12. Annual return

An annual return shall be made in Form X set out in the First Schedule.

13. Appeal

An appeal from the decision of the Board to the Minister shall be made in Form XI set out in the First Schedule.

14. Fees

The fees prescribed in the Second Schedule shall be payable in respect of the matters stated therein.
