1.    Title

These Regulations may be cited as the Tolls (Entry Fee etc.) Regulations.

2.    Interpretation

In these Regulations unless the context otherwise requires—

"appointed dealer" means a dealer in fuel or lubricants who has been appointed by the Board for the purposes of these Regulations and whose appointment, name and address have been notified in the Gazette;

"COMESA Treaty" means the Treaty establishing the common market for Eastern and Southern African States; and

"COMESA licence" means a licence issued under the COMESA Treaty.

3.    Entry fees

    (1) The entry fee for a heavy goods vehicle as provided for in section 18 of the Act—

    (a)    for vehicles registered outside Zambia and for which a valid COMESA licence has not been issued in the country where the carrier is resident or established, shall be 120 United States dollars or the equivalent of that amount in such other currency as the Minister may prescribe; and

    (b)    for vehicles registered outside Zambia and for which a valid COMESA licence has been issued in the country where the carrier is resident or established, shall be such fee according to the class of heavy vehicle as set out in the Schedule to these Regulations or the equivalent of that amount in such other currency as the Minister may prescribe.

    (2) The Board may by notice in the Gazette, notify the procedures for making payments under these Regulations.

4.    Purchase of fuel and lubricants

    (1) A person to whom section 20 of the Act applies shall not purchase any fuel or lubricants otherwise than in accordance with this regulation.

    (2) A person to whom section 20 applies shall—

    (a)    purchase fuel or lubricants only from an appointed dealer and;

    (b)    make payments for such fuel or lubricants in a prescribed currency in accordance with regulation 3.

    (3) The price of any fuel or lubricants sold under this regulation shall not differ from the price ordinarily paid by customers to whom this regulation does not apply:

Provided that if the government has allowed any particular subsidy or rebate to any class of users in Zambia, for example, as for agricultural use, then benefits of the subsidy or rebate shall not be available to a purchaser to whom this regulation applies.

    (4) Where the Board is satisfied that due to circumstances beyond the control of the person to whom this regulation applies a heavy goods vehicles was stranded for want of fuel or lubricants and to mobilise such heavy goods vehicle and enable it to reach the nearest appointed dealer, such person purchased a reasonable amount of fuel or lubricants in contravention of this regulation and that the matter was brought to the attention of the Board or the issue a certificate in that behalf.

    (5) A certificate issued under sub-regulation (4) shall be deemed, in respect of the purchase to have exempted that person and any person who sold the fuel or lubricant from the application of this regulation.

5.    Revocation of S.I. No. 129 of 1983

The Tolls (Entry Fee, etc.) Regulations, 1983 are hereby revoked.

1.    Title and commencement

These Regulations may be cited as the Tolls (Victoria Falls Bridge) Regulations and shall come into operation 30 days from the date of their publication in the Gazette.

2.    Interpretation

In these Regulations, unless the context otherwise requires—

"bus" means a vehicle for the carriage of passengers with a seating capacity of 24 or more passengers;

"minibus" means a vehicle for the carriage of passengers with a seating capacity of between 8 and 24 passengers;

"toll" has the meaning assigned to it in the Act; and

"toll collector" has the meaning assigned to it in the Act.

3.    Designation of Victoria Falls Bridge as toll point

The Victoria Falls Bridge is designated as a toll point for the purposes of the Act.

4.    Toll fee and toll collectors

    (1) The toll fees set out in the First Schedule are payable in respect of the vehicles specified in the first column of that Schedule.

    (2) The toll payable for the use of the Victoria Falls Bridge shall be paid to the toll collector specified in the Second Schedule at the payment point specified in that Schedule.

5.    Exemption

The following vehicles are exempted from paying any toll in terms of the Act—

    (a)    vehicles registered by a diplomatic mission that enjoys the privileges and immunities under the Diplomatic Immunities and Privileges Act;

    (b)    vehicles belonging to, or bearing the logo of, the Government of the Republic of Zambia and the Zambia Revenue Authority;
