The Road Traffic Act, 2002 shall come into operation on the date of the publication of this Order.

This Notice may be cited as the Road Traffic (Public Service Vehicles) (Operating Time) Notice.*
In this Notice unless the context otherwise requires-
"Act" means the Road Traffic Act, 2002;
"Agency" means the Road Transport and Safety Agency;
"public service vehicle" means any motor vehicle or trailer used for conveying passengers or goods for reward.
3. Restriction of hours of operation of public service vehicles etc.
(1) No person shall drive or operate a public service vehicle specified in the Schedule on a public road from 20:00 hours in the night to 05:00 hours in the morning.
(2) Any person who drives or causes or permits any person employed by the person or subject to that person' orders to drive a public service vehicle or truck and trailer during the hours specified in sub-paragraph (1) commits an offence and shall be liable, on conviction, to the penalty specified in section 225 of the Act.

These Regulations may be cited as the Road Traffic (Public Service Vehicles) (Speed Limiter) Regulations.
In these Regulations unless the context otherwise requires-
"speed limiter" means a device fitted into a public service vehicle to prevent such vehicle from exceeding a prescribed speed limit.
3. Requirement to fit speed limiter on public service vehicles
(1) Every public service vehicle which is authorised to carry passengers or goods shall be equipped by the owner of the vehicle with a speed limiter capable of regulating the speed of the motor vehicle.
(2) The owner or person in charge of the public service vehicle shall at all times maintain the speed limiter in good working order.
4. Inspection of speed limiter
A driver or person in charge of a public service vehicle shall, on demand by a road traffic officer in uniform or a police officer, authorise such officer to inspect the speed limiter referred to in regulation 3.
Any driver or person in charge of a public service vehicle who-
(a) contravenes the provisions of regulation 3; or
(b) obstructs a road traffic officer in uniform or a police officer in the performance of duties under Regulation 4; or
(c) in any way interferes with a speed limiter fitted on a public service vehicle;
commits an offence and shall be liable, on conviction to a fine not exceeding one thousand penalty units or to imprisonment for a period not exceeding three months, or to both.

These Regulations may be cited as the Road Traffic (Public Service Vehicles) (General Speed Limit) Regulations.
In these Regulations unless the context otherwise requires-
"inter city route" means a route whose final destination point lies outside the confines of a local route and falls within another local authority area;
"local authority" means a city council, municipal council or district council established under the Local Government Act;
"local route" means a route within the confines of a local authority area or within a radius of 50 kilometres from the main post office of the local authority; and
"peri-urban route" means a route whose final destination point is outside the confines of a local route.
3. Speed limits for public service vehicle carrying passengers
(1) Notwithstanding any other Regulations, every driver of a public service vehicle which is authorised to carry passengers shall not exceed the speed limit specified in sub-regulations (2) to (4).
(2) Any person who drives a public service vehicle with a seating capacity of up-to 25 passengers shall not exceed a speed of 65 kilometres per hour when operating on a local route.
(3) Any person who drives a public service vehicle with a seating capacity of between 26 to 35 passengers shall not exceed a speed of 80 kilometres per hour when operating on a peri urban route.
(4) Any person who drives a public service vehicle with a seating capacity of 36 and above passengers shall not exceed a speed of a hundred kilometres per hour when operating on an inter city route.
4. Speed limits for public service vehicle carrying goods
(1) Notwithstanding any other Regulations, every driver of a public service vehicle which is authorised to carry goods shall not exceed the speed limits specified in sub-regulation (2).
(2) Any person who drives a public service vehicle carrying goods-
(a) shall not exceed a speed of 65 kilometres per hour when operating on a local route; and
(b) shall not exceed a speed of 80 kilometres per hour when operating on an inter city route.
Any person who contravenes the provisions of these Regulations commits an offence and shall be liable, on conviction to a fine not exceeding one thousand penalty units or to imprisonment for a period of three months, or to both.

These Regulations may be cited as the Road Traffic (Blood and Breath alcohol Content) (Prescription) Regulations.
In these Regulations, unless the context otherwise requires-
"Act" means the Road Traffic Act, 2002; and
"Agency" means the Road Transport and Safety Agency.
3. Prescription of blood and breath alcohol content
For the purposes of section 158 of the Act, a person arrested for an offence under section 156 or 157 and who upon examination is found to have a blood alcohol content exceeding 0.8 milligrammes per mililitre or 80 miligrams or alcohol per 210 litres of breath shall be deemed to have been under the influence of intoxicating liquor, to such an extent as to have been incapable of having proper control of a motor vehicle, at the time when in charge of a motor vehicle on a road or when the person was driving or attempting to drive a motor vehicle on a road.
4. Revocation of S.I. No. 66 of 2005
The Road Traffic (Public Service Vehicles) (Blood Alcohol Content) (Prescription) (Regulations, 2005, are hereby revoked.
ROAD TRAFFIC (MARKING) REGULATIONS

These Regulations may be cited as the Road Traffic (Marking) Regulations.
In these Regulations, unless the content otherwise requires-
"heavy vehicle" has the meaning assigned to it in the Act;
"marking" means a retro-reflective rectangular strip, or a series of retro-reflective strips, placed on a heavy vehicle or trailer, in a manner that identifies the entire length and width of the heavy vehicle or trailer when viewed from the side or rear of the heavy vehicle or trailer; and
"trailer" means any vehicle that has no independent motive power of its own and that is drawn, or is designed to be drawn, by a motor vehicle, but excludes a side car attached to a motor-cycle or a farm implement that is not constructed or adapted for the conveyance of goods or a burden of any description.
3. Requirement to place marking on heavy vehicle or trailer
(1) An owner or a person in charge of a heavy vehicle or trailer shall place a marking on the heavy vehicle or trailer.
(2) An owner or a person in charge of a heavy vehicle or trailer shall, at all times, maintain themarking in good working order and retro-reflectivity.
(3) An owner or a person in charge of a heavy vehicle or trailer shall, on demand by a road traffic officer or a police officer, authorise the officer to inspect the marking on the heavy vehicle or trailer.
A person who contravenes Regulation 3, commits an offence and is liable, upon conviction, to a fine not exceeding one thousand penalty units or to imprisonment for a term not exceeding three months, or to both.

These Regulations may be cited as the Road Traffic (Chevron Signs) Regulations.
In these Regulations, unless the content otherwise requires-
"Chevron sign" means a retro-reflective strip, or a series of retro-reflective strips, arranged in a chevron pattern on the rear of a heavy vehicle or trailer;
"heavy vehicle" has the meaning assigned to it in the Act;
"trailer" means any vehicle that has no independent motive power of its own and that is drawn, or is designed to be drawn, by a motor vehicle, but excludes a side car attached to a motor-cycle or a farm implement that is not constructed or adapted for the conveyance of goods or a burden of any description.
3. Requirement to place marking on heavy vehicle or trailer
(1) An owner or a person in charge of a heavy vehicle or trailer shall place a marking on the heavy vehicle or trailer.
(2) An owner or a person in charge of a heavy vehicle or trailer shall, at all times, maintain the chevron sign in good working order and retro-reflectivity.
(3) An owner or a person in charge of a heavy vehicle or trailer shall, on demand by a road traffic officer or a police officer, authorise the officer to inspect the chevron sign on the heavy vehicle or trailer.
A person who contravenes regulation 3, commits an offence and is liable, upon conviction, to a fine not exceeding one thousand penalty units or to imprisonment for a term not exceeding three months, or to both.

2. Appointment of school traffic wardens
The persons whose names are set out in the First Schedule to this Notice are hereby appointed as school traffic wardens, for three years, in respect of the schools set out in the Schedule.

A school traffic warden shall wear a uniform prescribed in the Second Schedule to this Notice.

PART I
PRELIMINARY
(1) These Regulations may be cited as the Road Traffic (Public Service Vehicles) Regulations.
(2) These Regulations shall come into effect on the expiry of a period of 30 days after the date on which they are published in the Gazette.
[ED note: SI 39 of 2013 was also published in the Gazette with the same name. SI 63 of 2013 is published with addition of the Fourth Schedule and also with some changes in the content. Except these, the matters are one and the same and hence we retain the latest SI i.e., 63 of 2013.]
In these Regulations, unless the context otherwise requires-
"composite vehicle" means a motor omnibus in which the carrying of goods in addition to passengers is authorised;
"double-decked motor omnibus" means a motor omnibus having two decks one of which is wholly or partly above the other and each deck of which is provided with a gangway serving seats on that deck only; and
"single-decked motor omnibus" means a motor omnibus upon which no part of a deck or gangway is vertically above another deck or gangway.
PART II
PRESCRIBED FORMS AND FEES
The forms set out in the First Schedule shall be used in the cases to which they are respectively applicable in carrying out the provisions of the Act and these Regulations.
(1) The fees specified in the Road Traffic (Fees) Regulations, 2021, are the fees payable in respect of the matters set out in these Regulations.
(2) Where an appeal to the Tribunal is successful, the whole of the fee paid, or such other portion of the fee as the Tribunal may direct, shall be refunded to the appellant.

PART Ill
LICENSING OF PUBLIC SERVICE VEHICLES
5. Application for road service licence and for variation of terms or conditions of licence
(1) An application for a road service licence or for the variation of the terms or conditions of a licence held by the applicant shall be signed by the person requiring that licence or variation, or, if made by a corporate body or partnership firm, shall be signed by the person duly authorised in that behalf by that body, or a partner of the partnership firm, as the case may be.
(2) A road service licence shall not be granted if the motor vehicle proposed to be used as a taxicab is a tricycle or a motorcycle.

6. Written representations or objections
(1) Subject to sub-regulation (3), written notice of objections or other representations made under sub-section (8) of section 108 of the Act shall be in the form prescribed in the Third Schedule and shall be sent to the Director so as to reach the Director not later than 30 days after the notice of application required by that sub-section has appeared in the Gazette.

(2) A copy of written representations or objections shall be sent by the person making them to the applicant at the same time as it is sent to the Director.
(3) An application for a road service licence or for a variation of a road service licence, except information given by or on behalf ofthe applicant which is liable to be kept confidential and which the applicant has requested be kept confidential, shall be available for public inspection, free of charge, at the office of the Director during normal office hours until the application is finally disposed of.
(1) The Director shall, upon payment of the prescribed fee, issue an identity certificate in respect of a vehicle that is an authorised vehicle or substituted vehicle in a road service licence or short-term road service licence, as the case may be.
(2) A person shall require one identity certificate in respect of one vehicle.
(3) An identity certificate shall be valid until-
(a) the date of expiry of the road service licence or short-term road service licence in which the vehicle to which it relates is authorised; or
(b) the day upon which permission to use the vehicle as a substituted vehicle ends in the case of a vehicle that is a substituted vehicle.
(4) An identity certificate shall not be valid beyond the last day of the twelfth month following the date of its issue.
(5) An identity certificate shall, if a vehicle in respect of which it is issued is in use on a road, be displayed conspicuously upon the vehicle so as to be visible from the front or left front of the vehicle.
(6) An identity certificate may, in the case of a trailer, be carried on the trailer or in or on the vehicle drawing it at the time.
(7) A person who uses on a road any vehicle upon which the relevant identity certificate is not displayed in accordance with this regulation commits an offence and is liable to a fine of one hundred and fifty penalty units.
8. Replacement of licensed vehicle
(1) A holder of a road service licence may, if the vehicle specified in the road service licence has been destroyed, rendered unfit for service or withdrawn from service for overhaul or repair, apply to the Director for permission for the temporary use of another vehicle until the licensed vehicle is replaced or rendered fit for service.
(2) An applicant shall, if the Director so requires, send the identity certificate of the licensed vehicle to the Director.
(3) The carrying capacity of the vehicle which is the subject of the request for permission under sub-regulation (1) shall not exceed the carrying capacity of the licensed vehicle by more than 10 per cent.
(4) The Director shall, upon granting the permission requested under sub-regulation (1), retain the identity certificate of the licensed vehicle for as long as the temporary vehicle remains in use.
(5) The Director shall return to the licence holder the identity certificate ofthe licensed vehicle immediately upon the return to the Director of the identity certificate of the temporary vehicle.
(6) Permission granted under this regulation shall not be valid for a period exceeding three months.
9. Interchangeability of omnibuses used partly under concession and road service licence
Where a motor omnibus service provided by a concession holder operates partly on a concession route or in a concession area, and partly on a free road or in a free area, the concession holder may use in substitution for the motor omnibus specified in the road service licence held by the concession holder in relation to the free road or area any of the omnibuses used by the concession holder in providing the service on the concession road or in the concession area, so long as the concession holder does not exceed the maximum number of omnibuses which the concession holder is permitted to use under the road service licence, or the total number of passengers which the concession holder is permitted to carry.
10. Suspension of road services by operator
(1) A holder of a road service licence who wishes to suspend the operation of the service authorised in the road service licence, otherwise than for reasons outside the holder' control, shall obtain the prior permission of the Director, stating the reasons for the intended suspension and the period for which the suspension is to remain in force.
(2) The holder of a road service licence shall, where the service authorised in the licence is suspended for reasons outside the control of the holder of the road service licence and where the duration of the suspension exceeds three days, notify the Director immediately of the suspension of the service.
(3) A person who contravenes this regulation commits an offence and is liable, upon conviction, to a fine not exceeding three hundred penalty units.
11. Death, bankruptcy, etc., of holder of road service licence or short-term road service licence
(1) Where owing to the death, incapacity, bankruptcy or liquidation of the holder of a road service licence or short-term road service licence or to the appointment of a receiver, manager or trustee in relation to the holder' business the holder of a road service licence ceases to be the user of the vehicles authorised under the licence, the person carrying on the business of the holder shall be deemed to be the holder of the road service licence.
(2) The person by whom the business is carried out after the holder of a road service licence has ceased to be the user of the vehicles authorised under the licence shall-
(a) notify the Director that the holder of the road service licence has ceased to be the user of the authorised vehicles and the reason for the cessure; and
(b) apply for a new road service licence within 30 days of the sending of the notice referred to in paragraph (a).
(3) The period during which a person shall be deemed to be the holder of a road service licence under sub-regulation (1) shall not exceed the date on which the licence would have expired, but for the occurrence of that event, and shall terminate immediately the application under sub-regulation (2) is disposed of.
(1) A holder of a road service licence or a short-term road service licence shall make to the Director or any person nominated by the Director-
(a) a monthly return in Form PSV.6 set out in the First schedule; and
(b) an annual return in Form PSV.7 set out in the First Schedule;
in respect of each month or year during any part of which the person was the holder of the licence.
(2) A return shall be made in accordance with the following provisions-
(a) the annual return shall be in respect of the period of 12 months ending on 31st December, and shall be submitted to the Director not later than 3 months after the expiry ofthe period to which it relates; and
(b) the monthly return shall be submitted to the Director not later than the last day of the month following the month to which it relates.
(3) A holder of a road service licence or a short term service licence shall keep or cause to be kept records in such form and in accordance with such provisions as the Director may specify to show the daily movements of every public service vehicle authorised under the licence, other than a public service vehicle used by virtue of a concession.
(4) The records referred to in sub-regulation (3) shall show, in respect of each day of the week, and in respect of each vehicle separately-
(a) the places between which, or the areas within which, the vehicle was used;
(b) the period of use of the vehicle; and
(c) the work in connection with which the vehicle was used.

13. Trailers and passenger vehicles
(1) A motor omnibus, hire car or taxicab while towing a trailer shall not be used for carrying passengers.
(2) A person who uses or who causes to be used a motor omnibus, hire car or taxicab in contravention of sub-regulation (1) commits an offence.
14. Duties of driver or conductor
(1) A driver or conductor of a motor omnibus shall take all reasonable precautions to ensure the safety of passengers in or on, or entering or alighting from, the omnibus.
(2) A driver or conductor of any motor omnibus shall not-
(a) allow passengers to sit in any place in or on the omnibus other than upon the seats provided for passengers;
(b) except in omnibuses where standing passengers are allowed, permit any passenger to stand in or on the omnibus when it is in motion;
(c) allow any luggage or any other article to be placed in or near an entrance or exit for passengers in such a position as to cause any obstruction or danger to conductor persons entering or leaving the omnibus or, in the case of a double-decked motor omnibus, on the stairs of the double-decked motor omnibus;
(d) in a single-decked motor omnibus, allow the total height of any luggage or other loads placed on the roof of the omnibus to exceed a height equal to one-fifth of the maximum overall height of the omnibus measured from the ground to the highest point of the roof, except that no portion of the baggage shall be more than 3.81 metres above the ground;
(e) in a double-decked motor omnibus, allow any luggage or other loads to be placed on the roof of the omnibus;
(f) deceive or refuse to inform any passenger or intending passenger the the destination or route ofthe omnibus or the fare for any journey; or
(g) wilfully charge any passenger a higher fare than prescribed for any journey.
(3) A driver or conductor of a public service vehicle authorised to carry passengers shall ensure that the interior of the public service vehicles is clean and in sanitary condition at all times.
(4) A person who contravenes sub-regulation (1) commits an offence.
15. Identification of passenger public service vehicles
(1) A motor omnibus or taxicab shall be identified by the use of a reflective ribbon which shall be ten centimetres in width, pasted from the front to the rear on the mid-section of both sides of the vehicle.
(2) The reflective ribbon under sub-regulation (1) shall be ofa colour corresponding to the Province in which the motor omnibus or taxicab is licensed to operate as set out in the Fourth Schedule.
(3) A transport operator with a fleet of more than thirty vehicles may apply to the Director to be exempt from the provisions of this regulation and shall maintain the entire fleet in one colour to be approved by the Director.
(4) A passenger public service vehicle shall be registered with the Agency and shall be issued with a fleet code by the Director which shall be clearly inscribed on the front doors of the vehicle in visible letters in a font of two centimetres width and ten centimetres height.
(5) A public service vehicle shall, upon registration, be issued with, and required to affix on the front and rear ofthe vehicle, a red registration mark number.
(6) A luxury coach is exempted from the provisions of sub-regulations (1), (2) and (3).
16. Feature of taxicab and omnibus
(1) A taxicab or omnibus shall be fixed with an illuminating lamp on top of its roof each time it is on a public road or in operation.
(2) The illuminating lamp referred to in sub-regulation (1) shall always be in a working condition.
(3) An operator of an omnibus or taxicab shall ensure that the illuminating lamp on the omnibus or taxicab is always in a working condition.
(4) A taxicab or omnibus shall not have tinted windows otherwise than for purposes of protection from ultraviolet solar rays as provided by the manufacturer and approved by the Director.
A taxicab shall not operate as an omnibus.
18. Use of designated taxicab ranks
(1) A local authority shall designate areas as taxi ranks in the jurisdiction of the local authority for use by taxis only.
(2) A motor vehicle that is not a taxicab which parks at a taxi rank is liable to a fine of one thousand five hundred penalty units.
(1) A public service vehicle authorised to carry passengers may carry luggage belonging to the passengers.
(2) Only light hand luggage shall be carried inside a public service vehicle and heavy or awkward luggage shall only be carried in a separate luggage compartment or, if a guard rail is provided, on the roof of the public service vehicle.
(3) Only light hand luggage belonging to the passengers shall be carried in the passenger compartment in a public service vehicle authorised to carry goods and passengers.
(4) A double-decked motor omnibus shall not by virtue of this regulation be deemed to be permitted to carry goods or heavy or awkward luggage on the roof of the omnibus.
(5) A person who contravenes the provisions of this regulation commits an offence.
(1) An operator of a public service vehicle shall ensure that a ticket, other than one issued in respect of a motor omnibus service that is provided wholly within the area of a local authority, bears the stage or place where the passenger boarded the motor omnibus.
(2) A passenger in a motor omnibus commits an offence who-
(a) immediately upon demand, fails to declare the journey that the passenger intends to take or has taken and to pay the fare for the whole of that journey or produce a valid ticket for the journey;
(b) leaves or attempts to leave the motor omnibus without paying the fare for the journey that the passenger has made in it, and with the intent to avoid payment ofthe fare;
(c) fails to produce a ticket on demand by a road traffic inspector, police officer, conductor, driver or other duly authorised agent ofthe owner ofthe motor omnibus;
(d) uses any ticket which has been altered or defaced with intent to avoid payment ofthe fare;
(e) uses or attempts to use any ticket which has been issued to another person if that ticket indicates that it is not transferable; or
(f) refuses upon request to leave the motor omnibus on completion of the journey in respect of which the fare was paid.
(3) A passenger in a taxicab and in a hire car shall not leave or attempt to leave the taxicab or hire car without paying the fare for the journey that the passenger has made in that vehicle with the intent to avoid payment of the fare.
(4) A person who contravenes sub-regulation (3) commits an offence and is liable, upon conviction, to a fine not exceeding one thousand five hundred penalty units or to imprisonment for a period not exceeding six months, or to both.
21. Unlawful behaviour by passenger
(1) A person whilst travelling in or upon a motor omnibus shall not-
(a) spit in or upon or from the motor omnibus or any part ofthe motor omnibus;
(b) use obscene, indecent, offensive or quarrelsome language or gestures;
(c) behave in an obscene, indecent, offensive or quarrelsome manner;
(d) wilfully interfere in any way with the comfort of any passenger;
(e) wilfully obstruct or impede the driver or conductor in the exercise of their duties under these Regulations;
(f) wilfully damage the motor omnibus;
(g) enter or remain in or on the omnibus when requested not to do so by a driver or conductor on the ground that-
(i) the omnibus is carrying its full complement of passengers; or
(ii) the operator is debarred from picking up passengers at the place in question by reason ofthe terms ofor the conditions attached to the road service licence;
(h) sit in any place in or on any omnibus other than upon the seats provided for passengers;
(i) except in omnibuses where standing passengers are allowed, stand in or on the omnibus when it is in motion; or
(j) place any luggage or any other article in or near an entrance or exit for passengers in such a position as to cause any obstruction or danger to persons entering or leaving the omnibus or, in the case of a double-decked motor omnibus, on the stairs of the omnibus.
(2) A person in a state of intoxication shall not enter or remain in or on any motor omnibus.
(3) A driver or conductor of a motor omnibus shall not wilfully allow a person in an intoxicated state to enter or remain in or on any motor omnibus on which the driver or conductor is on duty as the driver or conductor.
(4) A person who contravenes the provisions ofthis regulation commits an offence.
22. Inflammable liquid in passenger carrying public service vehicle
(1) A person shall not cause or permit a public service vehicle authorised to carry passengers to be used on a road while the public service vehicle is carrying any inflammable or explosive substance and while passengers are actually being carried on the vehicle.
(2) Nothing in this regulation shall prohibit the carriage of petrol or other inflammable liquid-
(a) in the fuel tank ofa public service vehicle; or
(b) as a reserve supply of fuel for the public service vehicle in a container or containers properly constructed to prevent leakage in such a position on the vehicle and not exceeding such amount as may be approved by a vehicle examiner.
23. Matters to be displayed or inscribed on omnibus
(1) A person shall only cause or permit a motor omnibus or taxicab to be used on a road if there is displayed in a conspicuous place within the motor omnibus or taxicab vehicle a notice showing the fares authorised to be charged for conveyance in the omnibus or taxicab.
(2) A list of extra payments in respect of additional passengers or luggage, in a taxicab, shall be displayed in a conspicuous position in the interior of the taxicab.
(3) The time-table to which a motor omnibus is required to run shall be available for public inspection in the motor omnibus.
(4) A person who fails to comply with the provisions of this regulation commits an offence and is liable, upon conviction, to a fine not exceeding three hundred penalty units.
(1) A person who conveys any passenger in a taxicab shall operate a taximeter and only charge a fare indicated by the taximeter.
(2) These provisions shall not apply to journeys for which the charging of an agreed fare is authorised by the Director.
(3) All journeys in taxicabs shall be made by the shortest and most direct route except where otherwise specifically requested by the passenger .
(4) A person who, with intent to deceive, travels by a devious route contrary to this regulation commits an offence.
(1) The badge to be worn while on duty by the driver of every public service vehicle shall be made of metal or other durable material, and shall bear the words "Zambia P.S.V. Driver" and a distinguishing number.
(2) The badge referred to in sub-regulation (1) shall be issued free of charge by a licensing officer to any person licensed to drive a public service vehicle.
(3) A licensing officer shall, where a badge is lost or destroyed, upon application, issue a new badge to the applicant.
(4) A badge shall remain the property of the Republic and shall be returned to the licensing officer upon the person to whom it was issued ceasing to be licensed to drive a public service vehicle.
(5) A driver of a public service vehicle who when on duty, fails to wear a badge in a conspicuous position so that the distinguishing number is clearly legible commits an offence and is liable to a fine not exceeding three hundred penalty units.
26. Uniform for taxicab or omnibus drivers
(1) The driver of an omnibus, taxicab or a hire car shall, at all times when on duty, wear a uniform of a type and design approved by the Director.
(2) The uniform referred to in sub-regulation (1) shall be in a good state of repair and shall be kept clean and tidy.
(3) An omnibus, taxicab or hire car driver who contravenes the provisions of this regulation commits an offence.
PART V
GENERAL PROVISIONS
27. Establishment of taxis association
(1) There shall be established by taxicab drivers and operators an association, representing their interests, for recognition by the Government which shall be registered with the Registrar of Societies.
(2) An operator or driver who contravenes sub-regulation (1) commits an offence and is liable to a fine not exceeding one thousand five hundred penalty units.
28. Exemption from road service licence
A public service vehicle registered and licensed outside Zambia and used for the carrying of tourists booked and carried from, and, on the same tour, returning or going on to places outside Zambia may, for a period not exceeding 60 days, from the date on which the vehicle enters Zambia, be used on the roads in Zambia without a road service licence, except that goods shall not be carried on the vehicle other than the personal luggage of the tourists.
An appeal to the Road Service Appeal Tribunal shall be in writing and shall be accompanied by the prescribed fee and a copy of the Director' reasons for the decision, order or other act appealed against.
The Director may, subj ect to such conditions as the Director may specify, exempt the owner of any public service vehicle from complying with all or any of the provisions which the Director has power to exempt and direct that the exemption order be carried on the vehicle concerned.
A person who commits an offence under these Regulations for which no penalty is provided is liable, upon conviction, in the case of a-
(a) first offence, to a fine not exceeding three hundred penalty units; and
(b) second or subsequent offence, to a fine not exceeding one thousand five hundred penalty units or to imprisonment for a period not exceeding three months, or to both.

SI 33 of 2015.
(1) These Regulations may be cited as the Road Traffic (Certificates of Security and Insurance) (Display) Regulations.
(2) These Regulations shall come into operation on the expiration of a period of 30 days after the date on which they are published in the Gazette.
2. Issuance of security and insurance disc
(1) The Agency shall, when issuing a certificate of security to an applicant, issue to the applicant a disc in the form set out in the Schedule.
(2) An insurer shall, when issuing a certificate of insurance to an insured person, issue a disc in the form set out in the Schedule.
3. Display of insurance and security discs
(1) A holder of a certificate of security and a certificate of insurance shall display the disc referred to in regulation 2 on the motor vehicle or trailer in respect of which the disc is issued.
(2) A disc shall be displayed on a motor vehicle or trailer in a manner that ensures that the disc is easily distinguishable and clearly visible at all times, and does not become defaced.
(3) A person shall not use or permit another person to use a motor vehicle or trailer on which a security and insurance disc is not displayed in accordance with these Regulations.
A person who contravenes regulation 3 commits an offence and is liable, upon conviction, to the penalty specified in sections 86 and 225 of the Act.

These Regulations may be cited as the Road Traffic (Public Service Vehicles) (Restriction on Night Driving) Regulations, and shall come into operation on the expiration of 30 days from the date on which they are published in the Gazette.
In these Regulations, unless the context otherwise requires-
"Director" has the meaning assigned to the word in the Road Traffic Act, 2002;
[Ins by reg 2 of SI 78 of 2017.]
"local authority" means a city council, municipal council or district council established under the Local Government Act;
"local authority area" means the area under the jurisdiction of a local authority;
"local route" means a route within a local authority area or within a radius of 50 kilometres from the main post office or the local authority;
"specified vehicle" means a motor vehicle with a gross weight of six thousand five hundred kilograms or more;

"vehicle in transit" means a motor vehicle that is not intended for use in Zambia and which is in transit through Zambia from another country, and includes an unregistered vehicle intended for use in Zambia and in respect of which a temporal registration card is issued.
These Regulations apply to a public service vehicle and a specified vehicle.

4. Restriction on night driving
(1) A person or an owner of a public service vehicle or a specified vehicle shall not use the public service vehicle or specified vehicle, or cause or permit the public service vehicle or specified vehicle to be used on a public road between 2200 hours and 0400 hours.

(2) An owner or person in control of a vehicle in transit shall not drive or use the vehicle in transit on the road between 2100 hours and 0500 hours.

5. Application for exemption from restriction on night driving
(1) Despite regulation 4, a person or an owner of a public service vehicle or specified vehicle for the carriage of goods may apply to the Director for exemption from the application of regulation 4 in Form I set out in the Schedule.
(2) The Director may, within 21 days of receipt of the application-
(a) approve the application for a person to use a public service vehicle or a specified vehicle for the carriage of goods between 2200 hours and 0400 hours on terms and conditions that the Director may specify; or

(b) reject the application for exemption where the applicant fails to meet the terms and conditions as the Director may specify.
(3) The Director shall, where the Director approves an application for exemption, issue a notice of exemption in Form II set out in the Schedule.
(4) The Director shall, where the Director rejects an application under this Regulation, notify the applicant of the rejection in Form III set out in the Schedule.
(5) Where the Director does not make a decision on the application within the period specified in sub-regulation (2), the exemption shall be considered to have been issued.
(6) An exemption issued by the Director under these Regulations shall be valid-
(a) in the case of an applicant who has a road service licence, for the period of validity of the road service licence and any other relevant document unless the permit is revoked in accordance with regulation 7; and
(b) in the case of an applicant who has a specified vehicle, for a period not exceeding one year.

6. Restriction not to apply on local route
Regulation 5 does not apply to the use of a public service vehicle on a local route within a local authority area, except that a driver of a public service vehicle shall not drive the vehicle out of a local authority area after 2200 hours if the nearest local authority area where the driver is heading to is not the local authority area of final destination.

The Director may revoke the exemption that is issued under regulation 5 on the ground that any term or condition subject to which the exemption was issued has not been complied with.

These Regulations may be cited as the Road Traffic (Public Service Vehicles) (Global Positioning System) Regulations, and shall come into operation on the expiration of 30 days from the date on which they are published in the Gazette.
In these Regulations, unless the context otherwise requires-
"global positioning system" means an electronic system that is used to monitor the movement and speed of a public service vehicle; and
"global positioning system device" means an electronic gadget fitted on a public service vehicle to monitor the position and speed of the public service vehicle.
3. Installation of global positioning system and device on public service vehicles
(1) An owner of a public service vehicle shall-
(a) install a global positioning system on the public service vehicle;
(b) fit a global positioning system device on the public service vehicle; and
(c) ensure that the global positioning system and device are in working condition at all times.
(2) A person, or an owner of a public service vehicle, shall not use or cause or permit to be used on a road, the public service vehicle which is not equipped with a global positioning system device.
4. Inspection of global positioning system device
(1) A road traffic inspector in uniform or a police officer in uniform may inspect a public service vehicle to enforce the provisions of these Regulations.
(2) Despite sub-regulation (1), a road traffic inspector or police officer who is not in uniform may inspect a public service vehicle on production of an official identity card.
5. Extracts from global positioning system
An extract from a global positioning system which purports to be a true extract certified by a person managing or controlling the global positioning system shall be received in a court on production as prima facie evidence of the facts stated in the extract.
A person who-
(a) contravenes regulation 3;
(b) obstructs a road traffic inspector or police officer in the performance of duties under regulation 4; or
(c) interferes, in any manner, with a global positioning system device fitted on a public service vehicle,
commits an offence and is liable, upon conviction, to a fine not exceeding one thousand penalty units or to imprisonment for a period not exceeding three months, or to both.

In these Regulations, unless the context otherwise requires-
"child" means a child who is three years old or below;
"child car seat" means a seat used by a child in a vehicle for safety; and
"seat-belt" means a strap securing a person to a seat for safety in a vehicle.
3. Fitting and fastening of seat-belt
(1) A person shall not travel in a motor vehicle without fastening the seat-belt.
(2) A vehicle which is not fitted with a seat-belt shall be fitted with a seat-belt within a period of six months from the coming into force of these Regulations.
(1) A person carrying a child in a motor vehicle shall ensure that the child is strapped securely on a child car seat while travelling in the motor vehicle.
(2) A person carrying a child in a motor vehicle shall not put the child or cause the child to be put in the front passenger seat of the motor vehicle.
5. Prohibition of importation of cars not fitted with seat-belts
A person shall not import a motor vehicle which is not fitted with a seat belt.
A person who contravenes these Regulations commits an offence and is liable, upon conviction, to a fine not exceeding one thousand penalty units or to imprisonment for a term not exceeding three months, or to both.
7. Revocation of S.I. No. 67 of 1975

These Regulations may be cited as the Road Traffic (Public Service Vehicles) (Driving Hours) Regulations, and shall come into operation on the expiration of 30 days from the date on which they are published in the Gazette.
In these Regulations, unless the context otherwise requires-
"hours of rest" means the minimum period of rest required of a driver of a public service vehicle after driving the public service vehicle for the prescribed maximum hours of driving; and
"minimum distance" means the distance prescribed in regulation 3.
3. Restriction on drivers of public service vehicles
(1) A person shall not drive a public service vehicle, or cause or permit another person to drive a public service vehicle without taking a rest-
(a) for a continuous period exceeding eight hours in a day; or
(b) for periods amounting in the aggregate to 48 hours or more in a period of 7 days.
(2) A driver of a public service vehicle who has driven a public service vehicle for the period referred to in sub-regulation (1) shall take at least eight consecutive hours of rest before driving a public service vehicle.
A driver of a public service vehicle shall have intervals of rest of at least five minutes each after every two hours of driving.
(1) An owner of a public service vehicle shall cause to be kept in the public service vehicle a log book in the form set out in the Schedule.
(2) A driver of a public service vehicle shall complete a log book each time before using the public service vehicle for a journey.
A person who contravenes these Regulations commits an offence and is liable, upon conviction, to a fine not exceeding one thousand penalty units or to imprisonment for a term not exceeding three months, or to both.

These Regulations may be cited as the Road Traffic (Removal of Vehicles) Regulations, and shall come into operation on the expiration of a period of 30 days from the date on which they are published in the Gazette.
In these Regulations, unless the context otherwise requires-
"appropriate authority" means the Inspector General of Police, the Director of the Road Development Agency, the Director of the Road Transport and Safety Agency or any local authority;
"authorised officer" means a police officer, road traffic inspector or other person authorised by an appropriate authority;
"local authority" means a district, municipal or city council established under the Local Government Act;
"place of safety" means a car park, road traffic depot, police station yard, Government workshop yard or any other place considered to be a place of safety by an authorised officer;
"tow truck" means a vehicle with a chassis rated at 1,500 kilograms or greater by the vehicle manufacturer and equipped with a winch capable of lifting a maximum of 8000 kilograms; and
"heavy tow truck" means a vehicle with a chassis rated at 5000 kilograms or greater by the vehicle manufacturer and equipped with a winch capable of lifting a maximum of 30,000 kilograms.
(1) An authorised officer may require the owner or driver of a motor vehicle or other person in control or in charge of a motor vehicle to move it or cause it to be moved to a place of safety where the motor vehicle-
(a) has broken down or has been permitted to remain at rest on a road in contravention of the Act; or
(b) has been permitted to remain at rest on a reserve in a position or in such a condition or in such circumstances as to appear to an authorised officer to be likely to cause danger to persons using the road or to cause obstruction to those persons.
(2) Where the motor vehicle referred to in sub-regulation (1) cannot be moved under its own power by reason of the driver not being present, or because of a mechanical failure in some part of it, or for any other reason, an authorised officer may remove the vehicle, or arrange for its removal, from that road or road reserve to a place of safety.
(3) A person who contravenes this regulation commits an offence.
4. Expenses for removal and storage
An owner of a motor vehicle which has been removed, or in respect of which arrangements have been made for the removal, by an authorised officer, shall pay the expenses for the removal and storage set out in the Schedule.
5. Deeming vehicle to have been abandoned
For the purposes of regulation 6, a motor vehicle is abandoned if-
(a) after being examined by a vehicle examiner, it is not taken away by the owner from the place where it was examined within seven days of the examination; or
(b) after having been taken to a place of safety in accordance with regulation 3, it is not collected by or on behalf of the owner within seven days of its being taken to the place of safety.
6. Disposal of abandoned motor vehicle
(1) An appropriate authority may sell or dispose of an abandoned motor vehicle in accordance with these Regulations.
(2) The power of disposal conferred by this regulation shall not be exercisable in relation to a motor vehicle unless the appropriate authority takes the steps specified in regulations 7 and 8 as are applicable to the motor vehicle, and a period of six weeks has lapsed beginning with the taking of the first of those steps.
7. Tracing owner of motor vehicle
(1) An appropriate authority shall, before selling an abandoned motor vehicle-
(a) ascertain the owner of the motor vehicle from the motor vehicle register kept by the Agency or, where the owner cannot be ascertained from the motor vehicle register, apply, in writing, to the local authority or Commanding Officer of Police in whose area the motor vehicle was removed to ascertain the owner; and
(b) where the owner is ascertained, send a notice of the intention to sell the abandoned motor vehicle at the expiry of six weeks from the date of the notice.
(2) An appropriate authority may, where the owner of an abandoned motor vehicle cannot be found, publish the notice of the sale of the motor vehicle referred to in sub-regulation (1)(b), once in the Gazette and a daily newspaper of general circulation in Zambia.
8. Further inquiry for owner of vehicle
Where after the steps in regulation 7 have been taken and a motor vehicle is not claimed, the appropriate authority may make such further inquiries it considers reasonable to ascertain the owner of the abandoned vehicle.
9. Delivery of abandoned motor vehicle
(1) A person claiming to be the owner of a motor vehicle that has been removed or abandoned may, at any time, before the motor vehicle is sold, request for the delivery of the motor vehicle.
(2) An appropriate authority shall deliver a motor vehicle which has been removed or abandoned to the person claiming it under sub-regulation (1) if the person-
(a) tenders evidence of ownership of the motor vehicle; and
(b) pays the removal and storage expenses set out in the Schedule.
10. When inquiry is not necessary
(1) Where the owner does not claim the motor vehicle or has claimed the motor vehicle but fails to pay the expenses incurred in moving and storing the vehicle, the appropriate authority may offer the vehicle for sale by public auction.
(2) Where an abandoned motor vehicle, having been offered for sale by public auction under sub-regulation (1) is not sold, the appropriate authority may dispose of it in any other manner that it considers appropriate.
(3) Where an abandoned motor vehicle is sold under these Regulations, the appropriate authority shall, after deducting the removal and storage expenses and any other costs incidental to the disposal of the abandoned motor vehicle, pay the balance to the owner within one year from the date of the sale of the abandoned motor vehicle.
(4) Where the owner does not claim the moneys within the period stated in sub-regulation (2), the moneys shall be paid into the general revenues of the Republic.
11. Revocation of S.I. No. 54 of 1996

In these Regulations, unless the context otherwise requires-
"motor-cycle" has the meaning assigned to it in the Act; and
"protective helmet" means a head-dress prescribed in regulation 4 which is worn on the head of a person, with a strap securely fastened under the chin for safety and protection.
3. Prohibition of riding motor-cycle without protective helmet
(1) A person shall not ride a motor-cycle on a public road or be a passenger on a motor-cycle without wearing a protective helmet which is designed for use on the motor cycle.
(2) A person driving a motorcycle shall ensure that a passenger who is below the age of 10 years old wears a protective helmet.
A person shall not sell, offer for sale, let on hire or offer to let or hire any head-dress as a protective helmet other than the prescribed helmet.
5. Prescribed standards for helmets
A protective helmet for a motorcycle shall comply with the standards set out in the Schedule.
A person who contravenes these Regulations commits an offence and is liable, upon conviction, to a fine not exceeding one thousand penalty units or to imprisonment for a term not exceeding three months, or to both.

These Regulations may be cited as the Road Traffic (Disposal of Impounded Motor Vehicles) Regulations, and shall come into operation on the expiration of a period of 30 days from the date on which they are published in the Gazette.
In these Regulations, unless the context otherwise requires-
"appropriate authority" means the Road Transport and Safety Agency or the Zambia Police; and
"impounded vehicle" means a motor vehicle that is detained in respect of a contravention or suspected contravention of the Act.
3. Disposal of impounded vehicle
(1) An appropriate authority may sell, by public auction, an impounded vehicle if the impounded vehicle is not claimed by the owner within 30 days from the date of detention of the vehicle.
(2) Where an impounded vehicle, having been offered for sale by public auction under sub-regulation (1), is not sold, the appropriate authority may dispose of it in any other manner that it considers fit.
(3) An appropriate authority shall, before selling or disposing of an impounded vehicle under sub-regulations (1) and (2), advertise in the Gazette and in a daily newspaper of general circulation in Zambia of the intention to sell the impounded vehicle after the expiration of 30 days from the date of the advertisement.

(4) An appropriate authority shall not sell an impounded vehicle if the offender or the owner of an impounded vehicle pays the fine in respect of which the vehicle was impounded.

(5) For purposes of this regulation, where criminal proceedings are instituted against the offender or the owner of an impounded vehicle, the day next after the termination of the criminal proceedings shall be deemed to be the date of detention of the vehicle.

(6) Despite sub-regulations (3) and (5), an appropriate authority may apply to Court for an order to dispose of an impounded motor vehicle where-
(a) within a period of 30 days from the date of publication of the advert in sub-regulation (3)-
(i) the owner does not claim the vehicle; and
(ii) the offender, in a case where the owner is not the offender, does not appear before court.

(7) For purposes of sub-regulation (6), a person who claims an impounded vehicle or appears before court for prosecution shall sign in a register kept by the appropriate authority.

Where an impounded vehicle is sold under these Regulations, the appropriate authority shall, after deducting the fine and any other costs incidental to the storage and disposal of the impounded vehicle, pay the balance to the owner of the impounded vehicle.
An owner of a vehicle which has been detained, or in respect of which arrangements have been made for its detention, by an authorised officer, shall pay the expenses incurred in storing the vehicle as specified in the Schedule, if the motor vehicle is stored for a period exceeding seven days.

2. Prohibition of loading, offloading or parking
(1) A person shall not load or offload any commercial goods from a motor vehicle or park a motor vehicle of gross weight exceeding of three thousand five hundred kilograms on a road in Kabwe municipality set out in the First Schedule between the hours specified in the Second Schedule.
(2) A person who contravenes sub-regulation (1) commits an offence and is liable, upon conviction, to a fine not exceeding one thousand penalty units or to imprisonment for a term not exceeding three months, or to both.
3. Revocation of S.I. No. 165 of 1971

PART I
PRELIMINARY
These Regulations may be cited as the Road Traffic (Driving Licence) Regulations, and shall come into operation on the expiry of a period of 30 days after the date on which they are published in the Gazette.
In these Regulations, unless the context otherwise requires-
"articulated goods vehicle" means an articulated vehicle constructed or adapted for use primarily for the carriage or haulage of goods;
"articulated vehicle" has the meaning assigned to the words in the Act;
"driving licence" means a driving licence issued under regulation 8;
"endorsement" means an endorsement of a driving licence under the Act extending the validity of that licence to any other class of motor vehicle;
"first aid" means the initial assistance rendered to a road traffic crash casualty prior to evacuation to the nearest medical health institution;
"goods vehicle" has the meaning assigned to the words in the Act;
"heavy vehicle" has the meaning assigned to the words in the Act;
"hire car" has the meaning assigned to the words in the Act;
"pass certificate" means a pass certificate issued under regulations 7 and 18;
"public service vehicle driving licence" means a public service vehicle driving licence issued under regulation 20;
"recognised identification document" includes a refugee identification card and diplomatic identification card; and
"SADC" has the meaning assigned to the acronym in the Act.
PART II
DRIVING LICENCE
A motor vehicle shall, for the purposes of these Regulations, be classified as set out in the First Schedule.
4. Provisional driving licence
(1) A person who intends to obtain a driving licence or an endorsement shall apply to a licensing officer for a provisional driving licence in Form DL 1 set out in the Second Schedule.
(2) An application made under sub-regulation (1) shall be accompanied-
(a) in the case of a citizen, by a copy of a national registration card or passport;
(b) in the case of a non-citizen, by a copy of a passport or recognised identification document;
(c) by a copy of the driving licence where the application is for an endorsement; and
(d) where the application is for a driving licence, by a duly completed medical certificate in Form DL 2 set out in the Second Schedule.
5. Issue of provisional driving licence
(1) An applicant for a provisional driving licence shall undergo a theory test conducted by a driving examiner and demonstrate that the applicant understands the-
(a) rules of the road;
(b) road traffic signs;
(c) basic first aid; and
(d) controls of a motor vehicle of a class to which the application relates.
(2) A driving examiner shall ensure that the applicant satisfactorily completes a theory test in written, oral or electronic form.
(3) For purposes of sub-regulation (3), an applicant is considered to have satisfactorily completed a theory test if the applicant obtains a pass mark set by the Director for the class of motor vehicle or endorsement applied for.
(4) A licensing officer shall issue an applicant who passes a theory test with a provisional driving licence in Form DL 3 set out in the Second Schedule on payment of a fee set out in the Road Traffic (Fees) Regulations, 2021.

(5) A licensing officer shall, before issuing a provisional driving licence under sub-regulation (1)-
(a) ensure that the applicant signs the provisional driving licence; and
(b) record the particulars relating to the holder in the register of provisional driving licences, including any restrictions on the driver relating to corrective lenses and artificial limbs.
(6) A provisional driving licence issued under these Regulations is valid for a period of three months from the date of issue.
(7) The Director shall not issue to the same person or to a single applicant more than three provisional driving licences in respect of any one category of vehicles set out in the First Schedule within a consecutive period of 12 months commencing from the first issue of the provisional driving licence.
(8) A holder of a provisional driving licence shall, on the expiry of the period specified under sub-regulation (4), obtain a new provisional driving licence in accordance with this regulation.
(1) A holder of a valid provisional driving licence shall, on the expiry of the period of seven days from the date of issue of the provisional driving licence, undertake a driving test conducted by a driving examiner on payment of a fee set out in the Road Traffic (Fees) Regulations, 2021.

(2) Despite sub-regulation (1), the Director may permit a holder of a provisional driving licence to take a driving test before the expiry of seven days.
(3) A holder of a provisional driving licence shall before taking a driving test-
(a) submit a valid provisional driving licence authorising the driving of a motor vehicle of a class to which the holder is being tested for; and
(b) provide roadworthy motor vehicle of the class for which the applicant is being tested.
(4) A holder of a provisional driving licence shall, where a holder is unable to take a driving test on a date and time given by the driving examiner, inform the driving examiner, at least 24 hours before the test, in writing, of the holder's inability to take the test.
(5) A holder of a provisional driving licence who fails to comply with sub-regulation (4) shall not take the test until after the expiry of a period of seven days from the date of the failure to take the previously scheduled test.
(1) A driving examiner shall on, being satisfied that the holder of a provisional driving licence is competent to drive a motor vehicle of the class for which the holder was being tested for under regulation 6, issue the holder with a pass certificate in Form DL 4 set out in the Second Schedule.
(2) A pass certificate issued under sub-regulation (1) is valid for a period of 90 days from the date of issue.
(1) A licensing officer or any other person authorised by the Director shall, on being presented with a pass certificate and on payment of a fee set out in the Road Traffic (Fees) Regulations, 2021, issue to the holder of the pass certificate a driving licence in Form DL 5 set out in Second Schedule.

(2) Subject to sub-regulation (1), the licensing officer may, where the Agency is unable to issue a driving licence on demand, issue a holder of a pass certificate a temporary driving licence in Form DL 6 set out in the Second Schedule, pending the issue of the driving licence.
(3) A temporary driving licence issued under sub-regulation (2) is valid for a period of three months and may be extended for a further period of three months or a longer period that the Director may determine.
(4) A licensing officer or other person authorised by the Director shall, before a driving licence is issued under sub-regulation (1), record the particulars of the issued driving licence in the register of driving licences.
9. Validity of driving licence
A driving licence issued under these Regulations is valid for a period of five years.
10. Renewal of driving licence
(1) A holder of a driving licence shall, within three months before the expiry of a driving licence, apply to the Director for renewal of the driving licence in Form DL 1 set out in the Second Schedule on payment of a fee set out in the Road Traffic (Fees) Regulations, 2021.

(2) The Director shall renew a driving licence where the holder of the licence holds a driving licence to drive a class of motor vehicle to which the application for renewal relates.
(3) An application for renewal of a driving licence under sub-regulation (1) shall be accompanied by-
(a) a copy of driving licence being renewed;
(b) a medical certificate in Form DL 2 duly completed within 30 days preceding the date of application for renewal in the case of an applicant who is-
(i) seventy years of age or older; and
(ii) so requested by the Director.
(4) A holder of a driving licence who fails to apply for renewal of a driving licence within a period specified under sub-regulation (1) shall, in addition to the application fee under sub-regulation (1), pay a fee for renewal of an expired driving licence set out in the Road Traffic (Fees) Regulations, 2021.

11. Duplicate provisional driving licence or driving licence
(1) A holder of a provisional driving licence or driving licence who loses the licence or whose licence is defaced or damaged shall, within 14 days of the loss or damage, apply to the Director for the issuance of a duplicate provisional driving licence or a duplicate driving licence in Form DL 1 set out in the Second Schedule on payment of a fee set out in the Road Traffic (Fees) Regulations, 2021.

(2) An application made under sub-regulation (1) for a duplicate provisional licence or a duplicate driving licence shall be accompanied by-
(a) the original licence if the application relates to a licence which is defaced;
(b) a police report, where the original licence is lost or destroyed; and
(c) a copy of the applicant's national registration card, passport or recognised identification document.
(2) The Director shall, on receipt of an application under sub-regulation (1), and on being satisfied that an applicant's licence is not subject to a suspension or cancellation, issue a duplicate provisional driving licence or duplicate driving licence to an applicant in accordance with the Act.
(1) A person who wishes to change a name on a provisional driving licence or a driving licence shall apply, in writing, to the Director.
(2) An application made under sub-regulation (1) shall be accompanied by-
(a) in the case of a citizen, a certified copy of a national registration card or passport bearing the new name of the applicant;
(b) in the case of a non-citizen, a certified copy of a recognised identification document bearing the new names; and
(c) an affidavit in support of the application.
(3) The Director shall, on receipt of an application under sub-regulation (1), and on payment of a fee set out in the Road Traffic (Fees) Regulations, 2021, effect the change of name on the provisional driving licence or driving licence.

PART III
PUBLIC SERVICE VEHICLE DRIVING LICENCE
13. Prohibition from driving public service vehicle without PSV driving licence
(1) A person shall not drive or being the owner cause to be driven, a public service vehicle on a public road without a public service vehicle driving licence.
(2) Sub-regulation (1) shall not apply to-
(a) a person driving a hire car where that vehicle is hired out to that person without a driver;
(b) an examiner, road traffic inspector or traffic police officer performing that examiner's, inspector's or officer's duties as contemplated under the Act;
(c) a person driving a public service motor vehicle on a public road for purposes of testing the motor vehicle in the performance of the person's duties;
(d) a person driving a hearse; and
(e) a person driving a towing vehicle.
(3) A person who contravenes sub-regulation (1) commits an offence.
14. Classes of public service vehicle
A public service vehicle is, for the purposes of these Regulations, classified as set out in the First Schedule.
15. Public service vehicle provisional driving licence
(1) A person who intends to obtain a public service vehicle driving licence shall apply to the licensing officer for a public service vehicle provisional driving licence in Form DL 1 set out in the Second Schedule.
(2) An application made under sub-regulation (1) shall be accompanied by-
(a) a copy of the applicant's driving licence;
(b) a medical certificate in Form DL 2 duly completed within 90 days preceding the date of application;
(c) a copy of the applicant's national registration card or passport; and
(d) where the application relates to a licence to drive a vehicle conveying dangerous goods, a certificate of competence to handle dangerous goods issued by an institute recognised by the Director.
(3) An applicant under sub-regulation (1) shall undergo a theory test in written, oral or electronic form and shall demonstrate that the applicant understands the-
(a) rules of the road;
(b) road traffic signs;
(c) basic first aid;
(d) principles of defensive driving; and
(e) control of a motor vehicle of the class to which the application relates.
(4) For the purposes of sub-regulation (1), an applicant is considered to have satisfactorily completed a theory test if the applicant obtains a pass mark set by the Director for the class of public service vehicle applied for.
(5) A licensing officer shall issue to an applicant who passes a theory test a public service vehicle provisional driving licence in Form DL 3 set out in the Second Schedule, on payment of a fee set out in the Road Traffic (Fees) Regulations, 2021.

(6) A licensing officer shall, before issuing a public service vehicle provisional driving licence under sub-regulation (5)-
(a) ensure that the applicant signs the public service vehicle provisional driving licence; and
(b) record the particulars relating to the holder in a register of public service vehicle provisional driving licence register including any restriction, on the driver relating to corrective lenses and artificial limbs.
(7) A public service vehicle provisional driving licence issued under these Regulations is valid for a period of three months from the date of issue.
(8) The Director shall not issue more than three public service vehicle provisional driving licences in respect of a class of a public service vehicle under these Regulations to an applicant within a consecutive period of 12 months commencing from the date of the first issue of the public service vehicle provisional driving licence.
(9) A holder of a public service vehicle provisional driving licence shall on, the expiry of the 12-month period under sub-regulation (8), obtain a new provisional driving licence in accordance with this regulation.
16. Passenger public service vehicle re-test
A person who fails a theory test to drive a passenger public service vehicle shall not apply for a further test to drive a passenger public service vehicle of the same class until 14 days have elapsed from the date of the last test.
17. Public service vehicle driving test procedure
(1) A holder of a valid public service vehicle provisional driving licence shall, on the expiry of the period of seven days of the date of issue of the public service vehicle provisional driving licence, undertake a public service vehicle driving test conducted by the driving examiner and on payment of a fee set out in the Road Traffic (Fees) Regulations, 2021.

(2) Despite sub-regulation (2), the Director may permit a holder of a public service vehicle provisional driving licence to take a public service vehicle driving test before the expiry of seven days.
(3) A holder of a public service vehicle provisional driving licence shall before taking a public service vehicle driving test, submit a-
(a) valid public service vehicle provisional driving licence authorising the driving of a motor vehicle of a class for which the person is being tested for; and
(b) roadworthy motor vehicle of the class for which the applicant is being tested for.
(4) A holder of a public service vehicle provisional driving licence shall, where a holder is unable to take a public service vehicle driving test on a date and time given by the driving examiner, at least 24 hours before the test, inform the driving examiner, in writing of the holder's inability to take the test.
(5) A holder of a public service vehicle provisional driving licence who fails to comply with sub-regulation (4) shall not be allowed to take the test until after the expiry of a period of seven days from the date of the failure to take the previously scheduled test.
(1) A driving examiner shall on, being satisfied that the holder of a public service vehicle provisional driving licence is competent to drive a public service vehicle of the class for which the holder was being tested for under regulation 17, issue the holder with a pass certificate in Form DL 4 set out in the Second Schedule.
(2) A pass certificate under sub-regulation (1) is valid for a period of 90 days from the date of issue.
19. Public service vehicle driving licence
(1) A licensing officer or any other person authorised by the Director shall, on being presented with a pass certificate and on payment of a fee set out in the Road Traffic (Fees) Regulations, 2021, issue to the holder of the pass certificate a public service vehicle driving licence in Form DL 5 set out in Second Schedule.

(2) Subject to sub-regulation (1), the licensing officer may, where the Agency is unable to issue a holder of a pass certificate issued under regulation 18 a public service vehicle driving licence on demand, issue a temporary public service vehicle driving licence in Form DL 6 set out in the Second Schedule, pending the issue of the public service vehicle driving licence.
(3) A temporary public service vehicle driving licence issued under sub-regulation (2) is valid for a period of three months and may be extended for a further period of three months or a longer period that the Director may determine.
(4) A licensing officer or other person authorised by the Director shall, before a public service vehicle driving licence is issued under sub-regulation (1), record the particulars of the issued driving licence in the register of driving licences.
20. Validity of public service vehicle driving licence
A public service vehicle driving licence is valid for a period of three years from the date of issue.
21. Renewal of public service vehicle driving licence
(1) A holder of a public service vehicle driving licence shall, within three months before the expiry of the licence, apply to the Director for renewal of the licence in Form DL 1 set out in the Second Schedule on payment of a fee set out in the Road Traffic (Fees) Regulations, 2021.

(2) The Director shall, where an application for renewal of a public service vehicle driving licence is made 12 months after the expiry of the public service vehicle driving licence, renew the public service vehicle driving licence where the holder of the licence possesses a valid pass certificate.
(3) An application for renewal of a public service vehicle driving licence under sub-regulation (1) shall be accompanied by-
(a) a copy of the public service vehicle driving licence being renewed;
(b) a medical certificate in Form DL 2 duly completed within 30 days preceding the date of application for renewal in the case of an applicant who is-
(i) seventy years of age or older; or
(ii) so requested by the Director.
(4) A holder of a public service vehicle driving licence who fails to apply for renewal of a driving licence within a period specified under sub-regulation (1) shall in addition to the application fee under sub-regulation (1), pay for renewal of an expired driving licence the fee set out in the Road Traffic (Fees) Regulations, 2021.

22. Director to keep Registers of driving licences
(1) The Director shall keep and maintain a register of all driving licences issued and of endorsements and renewals made and shall record in such register the particulars of any order of a court or variation thereof transmitted to the Director under Part IV of the Act.
(2) The Director may, on an application by a person who demonstrates reasonable cause to require information from the Register, provide information in respect of a particular driving licence on payment of a fee set out in the Road Traffic (Fees) Regulations, 2021.

(3) Despite sub-regulation (1), no fee shall be payable when the person to whom copies are supplied is an officer of the Government or a local authority acting in an official capacity.
(4) The Director may cause any corrections or alterations to be made to the Register for purposes of the Act and these Regulations.
(1) A driving licence or provisional driving licence or its equivalent duly issued by the Defence Force shall, for purposes of driving a motor vehicle belonging to the Defence Force, be deemed to be a driving licence or provisional driving licence issued under the Act and these Regulations.
(2) A holder of a driving licence issued by the Defence Force who wishes to obtain a driving licence under the Act or these Regulations is exempted from undertaking a theory test or reverse test component of the driving test, unless the Director directs otherwise.
24. Possession of driving licence or public service vehicle driving licence
A holder of a driving licence or public service vehicle driving licence shall be in possession of the driving licence or public service vehicle driving licence when driving a motor vehicle of the class to which the driving licence or public service vehicle driving licence relates.
25. Recognition of foreign licences
(1) A document purporting to be a licence issued under any law in force in a country set out in the Fourth Schedule shall, subject to sub-regulation (2), be recognised as though it were a licence issued under these Regulations.
(2) A licence under sub-regulation (1) shall-
(a) have effect within the Republic only in respect of the class of motor vehicle for which it is validly issued in the country of issue;
(b) not apply for a period exceeding 90 days of the date of entry into the Republic, except for a licence issued by a country within the SADC region.
26. Procedure relating to foreign driving licence
Despite anything contained in the other provisions of these Regulations, a holder of a driving licence issued by a country listed in the Fourth Schedule is not required to undertake a theory test or reverse test component of the driving test, unless the Director, directs otherwise.
27. Driving licences issued in SADC region
Subject to Regulation a holder of a driving licence issued in the SADC region who applies for a driving licence under the Act is not required to undergo a theory test or driving test, unless the Director directs otherwise.
(1) The Director shall, in partnership with the relevant stakeholders, develop a driver curriculum and syllabus for training of drivers.
(2) A theory test taken under these Regulations shall be conducted in line with the provisions of the driver curriculum and syllabus.
The fees specified in the Road Traffic (Fees) Regulations, 2021, are the fees payable in respect of the matters set out in these Regulations.

A person who contravenes these Regulations commits an offence and is liable, on conviction, to a fine not exceeding one thousand penalty units or imprisonment for a period not exceeding three months, or to both.
30. Revocation of S.l. No. 122 of 1963
(1) The Roads and Road Traffic (Driving Licence) Regulations are revoked.
(2) Despite sub-regulation (1), a driving licence or a public service vehicle driving licence issued under the revoked Regulations shall continue to be valid until its expiry subject to its terms and conditions.
(3) A driving licence or a public service vehicle driving licence to be issued in accordance with the revoked Regulations after the commencement of these Regulations shall be issued in accordance with these Regulations.

Information for use by the Medical Practitioner |
|
(1) In the case of provisional or driving licence of categories A1, A, B1, B and BE the person has- |
(i) according to the Snellen Rating a minimum visual acuity, with or without corrective lenses, of 6/12 for each eye or, where the visual acuity of one eye is less than 6/12 or where one eye of the person concerned is blind or not used as in the case of diplopia, a minimum visual acuity for the other eye of 6/9; and |
(ii) a minimum visual field, in the case of a person with two eyes, of 30 degrees nasal and 55 degrees temporal in respect of each eye and, in the case of a person with one eye, of 50 degrees nasal and 70 degrees temporal, with or without corrective lenses. |
(2) In case of the provisional driver's licence of the categories C1, CE1, C and CE such person has- |
(i) a normal binocular field of vision and according to the Snellen Rating a minimum acuity, with or without corrective lenses, of at least 6/12 in the worst eye; and |
(ii) a minimum visual field of 50 degrees nasal and 70 degrees temporal in respect of each eye, with or without corrective lenses. |
(3) A person who is disqualified under this part shall be referred to a registered optometrist or ophthalmologist, who shall, at that person's expense, test that person's eyes in relation to the standards contemplated in these Regulations and the results of that test shall be accepted by the Director. |
(4) An applicant requiring corrective lenses to pass the vision test, shall be restricted from driving a motor vehicle when not wearing such corrective lenses. |
(5) An applicant that require glasses with telescopic lenses to pass the vision test shall not be issued a learner's or driver's licence. |
(6) No person shall not, when applying for a learner's or driver's licence, wilfully fail to disclose any disqualification under section 62 of the Act. |
(7) Any person who- |
(i) is the holder of a licence authorising the driving of a motor vehicle in this part; and |
(ii) becomes aware thereof that the applicant is disqualified from holding that licence, |
shall within a period of seven days after having so become aware of the disqualification, submit the licence to the Director. |

I declare that I do not suffer from epilepsy, that I have not been subject to fits, and that my physique, vision, hearing and bodily and mental fitness are such as to warrant the issue to me of a public service vehicle driving licence. |
I further declare that the answers to the questions put to me by the Medical Practitioner are true and complete, and I understand that if any statement made by me is to my knowledge false or in any material respect misleading, I am liable to a fine not exceeding seven hundred and fifty penalty units in the case of a first offence and to a fine not exceeding one thousand five hundred penalty units in the case of a second or subsequent offence. |

3. Revocation of S.I. No. 38 of 2008
SI 112 of 2021.
(1) These Regulations may be cited as the Road Traffic (Fees) Regulations.
(2) These Regulations shall come into operation on the expiration of a period of 30 days after the date on which they are published in the Gazette.
The fees set out in the Schedule to these Regulations shall be payable for the licences, certificates and other matters specified in that Schedule.
3. Revocation of S.I. No. 38 of 2008
The Road Traffic (Fees) Regulations, 2008, are revoked.
